Your order is not accepted until Vardentra confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Vardentra may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.

Cancellation requests are handled in accordance with our Order Cancellation Policy. Payments are processed in accordance with our Payment Policy.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. Vardentra is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Vardentra. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Vardentra, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Vardentra.

Our products include outdoor power equipment which, if used improperly, can cause serious injury or death. It is your responsibility to read, understand and follow all instructions, warnings and safety guidelines in the product manual provided with your item before assembling, fuelling or operating any product purchased from the Services.

You agree that you will use all products in accordance with the manufacturer's instructions and all applicable laws and regulations, and that you will ensure that only trained, competent and appropriately aged persons operate the equipment. We are not responsible for any injury, damage or loss arising from improper assembly, fuelling, storage, maintenance or operation of a product, or from failure to follow the product manual.

Nothing in this Section limits any statutory rights you may have under applicable law.

SECTION 15 - TERMINATION AND RESTRICTION OF ACCESS

The obligations and liabilities of the parties incurred prior to any termination or restriction of your access to the Services shall survive.

We do not warrant or make any representations about the accuracy, completeness, reliability or availability of any information on the Services, and we will not be liable for any errors or omissions in that information or for any losses, damages or injuries arising from your use of or reliance on that information, except as expressly provided in our Warranty Policy.

Some jurisdictions do not permit the exclusion of certain warranties, so the above exclusions may not apply to you. This Section, together with our Warranty Policy, sets out the entire liability of Vardentra and your sole and exclusive remedy with respect to any defect in a product.

To the fullest extent permitted by applicable law, in no event shall Vardentra, nor any of our directors, employees, agents, partners or suppliers, be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, use, goodwill or other intangible losses, arising out of or in any way connected with: (a) your access to or use of (or inability to access or use) the Services; (b) the purchase, delivery, assembly or use of any product obtained from the Services; or (c) any conduct or content of any third party on the Services, whether based on warranty, contract, tort (including negligence), statute or any other legal theory, and whether or not we have been advised of the possibility of such damages.

In no event shall our total liability arising out of or in connection with the Services or any product purchased through the Services exceed the amount you paid for the product giving rise to the claim.

SECTION 19 - SEVERABILITY

If any provision or part of a provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. The parties will replace any invalid, void or unenforceable provision with a valid provision that most closely reflects the intent of the original provision.

These Terms of Service and any dispute or claim arising out of or in connection with them, their subject matter or their formation shall be governed by and construed in accordance with the laws of the State of Colorado, United States, as stated in our Legal Notice, without regard to its conflict of law provisions.

You agree to submit to the personal jurisdiction of the courts located in the State of Colorado for the purpose of litigating any such claims, except that nothing in these Terms affects your right to bring a claim in your local courts where you live if you are a consumer and applicable law so provides.
